The Public Interest Disclosure (Whistleblower Protection) Act

The Board determines complaints of alleged reprisal under The Public Interest Disclosure (Whistleblower Protection) Act. The Board does not investigate disclosures of wrongdoing: that is the role of designated officers within public bodies or the Manitoba Ombudsman. Reprisal complaints may only be brought to the Board after first being made to the Ombudsman.

The Elections Act

The Board determines requests from employers to be exempted from the leave without pay requirements under The Elections Act. The Chairperson of the Board, together with the Chief Electoral Officer, is also responsible for appointing a person (retired judge, where possible) to determine applications challenging the right of an elected candidate to take office or the validity of an election. The Board also determines unfair labour practice complaints alleging a breach of section 14 (leave without pay) or section 20 (right to reinstatement; employer’s obligations; etc.) of The Elections Act.

The Public Schools Act

The Board has general jurisdiction over labour relations matters and collective bargaining involving teachers governed by The Public Schools Act, except where The Public Schools Act provides otherwise.
